Terms of Service

These Terms of Service ("Terms") govern your use of the FurShare website, mobile application, and related services (collectively, the "Service") operated by SilverLobo LLC ("FurShare," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility & Accounts

You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to create an account. You are responsible for your account credentials and for all activity under your account. Tell us right away at contact@silverlobo.org if you suspect unauthorized use. Information you provide must be accurate and kept up to date.

2. The Service & Early Access

FurShare helps pet parents create and share care plans for their pets. Portions of the Service may be offered as a beta or early access release; these features are provided for evaluation, may change or be discontinued at any time, and may contain errors. We may modify, suspend, or discontinue any part of the Service at any time. Features that are free during early access may later require a paid plan; we will communicate pricing before charging you.

3. Not Veterinary Advice

FurShare is an organizational tool, not a veterinary service. The Service does not provide veterinary, medical, or professional advice, and nothing in the Service should be treated as such. Care plan content is created by pet owners, and we do not verify its accuracy. You are solely responsible for the accuracy and completeness of the information in your care plans, and caregivers are responsible for exercising their own judgment. If your pet has a medical emergency, contact a licensed veterinarian or emergency animal clinic immediately.

4. Your Content

You retain ownership of the content you add to the Service, including pet profiles, care plans, and photos ("Your Content"). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely as needed to operate, provide, and improve the Service — including displaying a care plan to the people you share it with. This license ends when you delete Your Content or your account, except for copies reasonably retained for backup or legal purposes.

You are responsible for Your Content and must have the rights necessary to share it. Do not upload content that is unlawful, infringing, or harmful.

5. Sharing Care Plans

When you share a care plan link, anyone with that link can view the plan and may copy or forward it. You are responsible for choosing who to share with. We are not responsible for the actions of people you share your care plan with, and we are not a party to any arrangement between you and a sitter, caregiver, or other third party.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Access another user's account or care plans without authorization
• Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or its systems
• Scrape, copy, or harvest data from the Service, or use it to build a competing product
• Upload malicious code or content that is abusive, deceptive, or infringes others' rights
• Use the Service to send spam or unsolicited communications

7. Intellectual Property

The Service — including its design, branding, logos, graphics, text, and software — is owned by SilverLobo LLC and protected by intellectual property laws. Except for Your Content, you may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written permission. "FurShare" and the FurShare paw logo are trademarks of SilverLobo LLC.

8. Apple App Store

If you download FurShare from the Apple App Store: these Terms are between you and SilverLobo LLC, not Apple. Apple has no obligation to provide maintenance or support for the app, is not responsible for addressing any claims relating to the app (including product liability, legal compliance, or intellectual property claims), and is a third-party beneficiary of these Terms with the right to enforce them against you. Your use must also comply with the App Store Terms of Service.

9. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us or other users, or if we discontinue the Service. Sections that by their nature should survive termination (including 3–5, 7, and 10–13) will survive.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, ERROR-FREE, OR UNINTERRUPTED, OR THAT CARE PLAN CONTENT WILL BE ACCURATE, COMPLETE, OR UP TO DATE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SILVERLOBO LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, GOODWILL, OR PROFITS, OR ANY HARM TO OR LOSS OF A PET — ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, OR FROM THE ACTS OR OMISSIONS OF ANY CAREGIVER OR OTHER USER. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless SilverLobo LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any third party's rights.

13. Governing Law & Disputes

These Terms are governed by the laws of the United States and the state in which SilverLobo LLC is organized, without regard to conflict-of-law principles. Before filing a claim, you agree to contact us at contact@silverlobo.org and give us a good-faith opportunity to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in that state, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and provide notice through the Service or by email where appropriate. Continued use of the Service after changes take effect means you accept the updated Terms.

15. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and SilverLobo LLC regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
